Waffenschrank terms of use
Résidents du Québec : la version française de ces conditions.
0. What this is about
Waffenschrank – the app, the web app and waffenschrank.app – is provided by tap & type UG (haftungsbeschränkt), Pestalozzistr. 14, 14943 Luckenwalde, Germany (→ legal notice). These terms apply as soon as you create an account, buy Pro, publish a showcase, or create, join or redeem a seat on a club page. If you use Waffenschrank without any of that, there is nothing for you to accept; the law applies – sections 1 and 2 still tell you what the app does and what you should look out for. Waffenschrank is meant for adults: an account, a showcase and a club page require you to be at least 18 years old.
1. What Waffenschrank is – and what it is not
Waffenschrank is a tool for managing your own inventory, permits, deadlines and training. The app’s calculations are based on your entries and on general legal information that we have compiled from the laws of the supported countries; we state when that information was last updated and, where possible, its source. It does not examine your individual case, it is not a substitute for legal advice or for information from your authority, and it is not an official register. The training log replaces neither the range book nor the certificate from your association. What counts is always the law, your permit and the decision of your authority. Ballistics calculations apply to standard conditions – check them at the range. Take load data exclusively from the information published by the powder or bullet manufacturer.
2. Your data and your backup
Your data is stored on your device, and in the web app in your browser’s storage. If you lose the device, delete the website data or the app, and there is no backup, the data is gone. So set up a backup (iCloud or Google Drive backup, account backup or export) and check now and then that it is running. Only you and your device know the protection password of an encrypted backup; we can neither see it nor reset it. How we handle data is described in the privacy policy.
3. Pro: subscription and one-time purchase
(1) Pro is available as a subscription and – only until December 31, 2026 – as a one-time purchase. Purchases are made through the App Store or Google Play; the seller there is Apple or Google, and their terms govern payment, renewal, cancellation and refunds. Your use of Pro is governed by these terms and, on iPhone and iPad, additionally by Apple’s standard end user license agreement; if the two conflict, the provision more favorable to you applies.
(2) A subscription unlocks Pro for as long as it runs.
(3) The one-time purchase unlocks Pro without a time limit, for as long as we offer Waffenschrank – that is, for as long as we make the app available in an app store or as a web app. Features that need our servers (currently: account backup, additional showcases, creating club pages and Pro in the browser) will only be discontinued after at least twelve months’ notice, unless a law or an authority forces us to act sooner; in that case your rights are governed by paragraph 5. We will not switch off the Pro features that run on your device, and the export of your data remains usable for as long as your device can run the app.
(4) For everyone who bought the one-time purchase, paragraph 3 is our minimum commitment; any further rights arising from your purchase remain unaffected.
(5) We may only change Pro for a valid reason – for example because of a change in the law, requirements of the operating systems or stores, for security reasons, because a service provider discontinues a service and there is no equivalent replacement, or because we discontinue a feature entirely under paragraph 3 – and only if this causes you no additional costs. If a change affects your use more than insignificantly, we will tell you at least 30 days in advance (by email if you have an account, otherwise in the app), and you can end the contract free of charge within 30 days of that message or of the change; what you are then refunded is governed by the law. Longer periods under paragraph 3 remain unaffected.
4. Account, showcases and club pages
(1) You can delete your account in the app at any time. We only terminate an account for a serious reason – for example in the event of abuse or unlawful content – or if we discontinue the features it needs under section 3(3).
(2) Everything you display publicly in a showcase or post in a club is additionally governed by the terms of use for showcases and club posts. They set out what is not allowed, how to report content and how we decide.
5. Liability
(1) We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the mandatory provisions on product liability and to the extent that we have given a guarantee.
(2) This paragraph applies only if your habitual residence is in Germany, Austria, Switzerland or the United States. It does not apply in Canada – including Québec – or in the other countries; there we are liable under the law even for slight negligence. In cases of slight negligence, we are only liable if we breach an obligation whose fulfillment makes the proper use of Waffenschrank possible in the first place and on whose observance you may regularly rely – for example, that the app does not falsify or lose your entries – and then only for the damage that was typically foreseeable when the contract was concluded.
(3) Your statutory rights in the event of defects – repair, price reduction and termination of the contract – remain unaffected. Claims for damages are governed by paragraphs 1 and 2.
(4) If your habitual residence is not in Germany, you keep the protection of the mandatory consumer protection laws of your country.
(5) Users in the United States
Waffenschrank is provided as is, without any promise that it fits your particular situation. It is not a substitute for the advice of an attorney. Section 5(2) applies to you. There is no arbitration clause and no class-action waiver in these terms. Nothing in these terms limits a right you have under a law of your state that cannot be waived by contract.
6. Governing law, jurisdiction, dispute resolution
(1) German law applies. If you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the country in which you have your habitual residence. If your habitual residence is in Switzerland, Swiss law applies instead of German law.
(2) We do not agree on a place of jurisdiction with consumers; where the law provides for this, you can also sue us in the courts of your place of residence.
(3) We are not willing, and not obliged under German law, to take part in dispute resolution proceedings before a consumer dispute resolution body. If such a body in your country can take up your complaint even without our consent, that route remains open to you.
7. Changes to these terms
(1) New versions are published on this page with their date. They apply to everything you newly start after they take effect – an account, a purchase, a showcase or a club.
(2) For a contract that already exists, a new version only applies if you agree to it. We will then ask you in the app; if you do not agree, the previous version continues to apply. Changes to Pro itself are governed by section 3(5).
8. Language versions
These terms are available in several languages. If versions differ, the one more favorable to you applies.
9. Consumers in Québec
The Consumer Protection Act applies to you. Nothing in these terms requires you to use arbitration or prevents you from going to the courts of Québec. We do not change these terms without your consent (section 7); any change to Pro is announced at least 30 days in advance (section 3(5)).
